GENERAL CONDITIONS AND INSTRUCTIONS FOR TOURIST ARRANGEMENTS
General terms and conditions are an integral part of all our arrangements and are attached to catalogs and price lists. Upon signing the contract, the passenger is acquainted with the general conditions and instructions and irrevocably agrees with them.
APPLICATIONS
Applications for the trip are accepted by the MAJOLKA travel agency and all authorized agencies in terms of the conditions stated in the travel program. Upon registration, TA MAJOLKA and the passenger enter into a contract (application form). The passenger fills in the registration document, which is also a confirmation of the reservation and contains information about the traveler’s travel arrangement, or refers to the program of the arrangement, where this information is provided. Upon check-in, the passenger must provide all information and submit all documents required by the travel program and pay a registration fee of 30% of the total arrangement and the cost of the reservation in the amount of 20.00 EUR per registration form (voucher) or. EUR 30.00 for custom-made trips. In the event of deferral of payment by check or other means of payment, the cost of the reservation is increased by the cost of processing the means of payment (accurate information at the point of sale). If the participant of the trip was registered by a legal entity, it can also be an order form, fax, e-mail, but only this must be confirmed by us, and the cost of the reservation is the same as for natural persons. In the event that the passenger does not provide the correct information at check-in, he is responsible for all costs or. consequences of incorrect data. Passenger registration is binding. It may be waived only in accordance with the provisions on passenger cancellation set out in the General Terms and Conditions. For a binding application, in addition to the explicit written application or A signed contract also includes any order submitted orally or in writing containing the name and surname of the passenger and other participants, credit card number or identification of another payment instrument, payment of the registration fee or part thereof, payment of registration fees or an act indicating that the passenger has submitted a binding declaration or a declaration containing any of the above information. If you do not find the desired object in the catalog, we will be happy to send you a reservation of your choice. When booking “according to your wishes”, it is necessary to pay 40.00 EUR (for a reservation 10 days before departure, 30% of the estimated value of the arrangement) as a guarantee for the reservation. In case of your confirmation, the amount paid will be credited to the final payment, but in case you change your mind and do not confirm the reservation, we will keep the money as the cost of making the reservation. EUR 20.00 must be paid for each change of the already confirmed booking reservation.
PAYMENT
Upon check-in, the passenger pays 30% of the price of the package as a registration fee, and the difference to the full price must be paid no later than 14 days before departure. Payment for the trip may be subject to special payment benefits, for which a special contract must be concluded, which specifies them. Closed groups may also have different payment terms.
PRICES
The price of the trip is determined and published in the programs and is calculated on the day of publication. Prices are in EUR. The organizer may provide in the program that the passenger pays for services to be performed abroad, directly to a foreign person, in the manner specified in the program. In this case, the passenger asserts his claims directly to a foreign person. The Agency reserves the right to change the price of the trip in the event of changes in the exchange rate, exchange rate, changes in transport prices or a smaller number of passengers, as stated in each program. The agency may inform the passenger in writing or orally about the price increase. The consent of the buyer is not required to increase the price of the arrangement up to 10%. However, if the increase exceeds 10%, the buyer has the right to terminate the contract without having to pay compensation. We also reserve the right to correct prices and information published in the price list, which would be due to a large amount of price and forward data or typographical errors.
SERVICES ARE INCLUDED IN THE PRICE OF THE ARRANGEMENT
Unless otherwise specified in the program, the price of the arrangement includes transport, hotel and catering services listed in the program and the organization of the trip. Unless otherwise specified in the program, the prices of individual arrangements for an adult are valid for accommodation in a double or triple room.
SPECIAL SERVICES
Special services are services that are not included in the price of the package (single room, special meals, additional excursions,…) or for which the program provides additional payments (visas, airport fees,…), so the passenger pays separately, unless otherwise specified in the program. If special or additional services, the passenger pays extra to the price of the arrangement at check-in at the check-in point. The number of passengers required to make the trip is stated in the program. In the case of an individual application for the trip, the passenger can leave it to the agency to try to find a partner or. a passenger on the same trip with whom he will share a room. Notwithstanding the above, the individually registered passenger must pay a surcharge for 1/1 room upon check-in. In the event that a passenger is found for an individually registered passenger, the passenger will be refunded the surcharge for 1/1 room.
PASSENGER CANCELLATION OR CHANGE OF ARRANGEMENT
If the passenger or legal entity cancels the trip, which is confirmed in writing at the place of registration, the Agency reserves the right to reimbursement of cancellation costs, the amount of which depends on the time in which the passenger submitted the cancellation:
up to 30 days before departure 10% of the package price
29 to 22 days before departure 20% of the package price
21 to 15 days before departure 30% of the package price
14 to 10 days before departure 50% of the package price
9 to 1 day before departure 80% of the package price
from 24 hours before departure and after departure 100% of the package price

up to 45 days before departure 10% of the package price
44 – 35 days before departure 50% of the package price
34 – 9 days before departure 80% of the package price
8 days until the start of the service 100% of the price of the arrangement
Irrespective of the cancellation costs set out above, they may also be higher when this is conditioned by the conditions of organizing the trip, which are dictated by THIS MAJOLKA by the applicable conditions of sale and are conditioned by the business partners. Upon oral cancellation of the trip, the passenger must sign the cancellation document, which is offered to him for signature by the seller. If he refuses to sign this document, it is considered that he has not canceled the trip. During the trip, the passenger may interrupt the trip only at his own request, on the basis of a written statement of termination. In case of travel interruption, he is not entitled to a refund upon return.
WITHDRAWAL – RISK OF CANCELLATION
If the passenger anticipates the possibility of not attending the trip at check-in due to certain circumstances, he / she can pay a cancellation fee at the agency. The severance agreement is valid in case of illness, death or accident of himself or his close relatives (parents, children, spouse). The severance pay may be claimed only upon presentation of the relevant certificate. The amount of the cancellation fee is determined annually and amounts to 5% of the price of the arrangement. The passenger must cancel the trip immediately or no later than 24 hours from the occurrence of the cause of cancellation. When the reason for the cancellation of the trip is such a deterioration in the health of the passenger or his relative (kinship must be evident from the relevant document), which prevents the passenger from traveling, he must submit a medical certificate or. certificate, which must contain the following information: date of deterioration of health condition brief history of the disease that prevented the insured from traveling type of therapy information that the sick leave coincides with the beginning of the deterioration of health status.
Irrespective of the cancellation fee paid, the organizer has the right to reimbursement of administrative costs in the event of the passenger’s cancellation of the trip. booking costs amounting to EUR 20.00 per voucher or referrals. The program can be used to determine a different amount of severance pay or that severance pay is not possible. If the passenger does not start the trip on the day set as the start of the trip and does not cancel it no later than 24 hours before departure (but obligatorily within the agency’s regular working hours), he is not entitled to a refund based on the cancellation fee. In the event that the passenger cancels the trip due to force majeure, but has not paid the cancellation fee, TA Majolka has the right to reimbursement of all its costs, and returns the difference to the passenger. When claiming cancellation risk, the passenger’s participation amounts to 10% of the package price (90% of the package price is therefore refunded to the passenger).
OBLIGATIONS OF THE ORGANIZER
The organizer is obliged to provide the services provided in the program and take care of the rights and interests of the passenger, in accordance with good business practices. This applies to own services as well as to the provision of third party services (hotels, tours, transport, ().
CANCELLATION OR CHANGE OF TRAVEL
The trip can be canceled by the organizer in case of insufficient number of applications (min number of applications is specified in the program), administrative measures or force majeure. The agency informs the passenger no later than 7 days before departure. In these cases, the organizer does not pay any claims, but has the right to change the program if circumstances of a technical nature so require. The Agency cannot accept responsibility for changes to the program due to any force majeure that may occur during the course of the program. In this case, the agency may provide services in a modified form, as appropriate. We reserve the right to replace the Slovenian-speaking local guide with a Croatian, German or English-speaking local guide in case of insufficient number of registered passengers, and to inform the passengers before departure. In the event of Majolka’s cancellation of the trip, the passenger is not entitled to reimbursement of the visa required to enter the country to which he is supposed to travel or the costs of vaccinations required by the program. The organizer can change the accommodation agreed upon in the contract, which can also happen only on the spot, but only with accommodation of the same or higher category and at his own expense. Also, the agency is not responsible for changes to the flight schedule (both in scheduled and charter traffic), which can also happen just before departure. We reserve the right to change the airline and the carrier and the domicile airport or port, and any delays or other changes of carriers are the sole responsibility of the airlines and carriers.
INFORMATION
Oral information received by the passenger at the point of sale does not bind the organizer more than the information in the offer or travel program.
COMPLAINTS
In the event of incomplete performance of the services listed in the program, the passenger may claim proportionate compensation by written complaint in the following procedure: the passenger must complain on the spot of inappropriate service to the organizer’s representative, Evidence of timely complaint on the trip if the cause of the complaint cannot be eliminated, the passenger and his representative draw up a written confirmation no later than 60 days after the arrangement must submit his written complaint at the point of sale where he applied and attach a written confirmation signed by a representative and any invoices for additional costs, the organizer is obliged to issue a written decision to the complaint within 8 days of its receipt or, if the passenger has not attached all necessary documents, within the time required to obtain them. This excludes the buyer’s right to compensation for ideal damage.
TRAVEL DOCUMENTS
Passports and visas and other documents required for the trip are the concern of each passenger and therefore the organizer disclaims any responsibility if the passenger has to interrupt the trip due to unorganized documents or can not travel at all. The passenger bears the same costs as if he had taken part in the trip. The passenger is obliged to obtain visas for the countries to which he travels and for which visas are required. However, if the passenger does not fulfill this obligation, TA Majolka will comply with the provisions on cancellation of the trip. In the event that the passenger is issued a TA Majolka visa, the latter does not guarantee the success of obtaining the visa. Mediation in obtaining a visa is paid separately and is not included in the price of the trip, and in case of cancellation of the trip, these costs are not reimbursed to the passenger.
LOSS OF DOCUMENTS
In the event that the passenger loses documents during the trip or only these are stolen, but they are necessary to continue the trip or to return home, the passenger obtains new ones at his own expense. When arranging the formalities related to the documents, you can turn to the tour leader or agency representative. However, if the passenger has to interrupt the trip due to loss or theft, he is not entitled to a proportional refund of the paid trip.
FOREIGN EXCHANGE AND CUSTOMS REGULATIONS
A passenger traveling abroad is obliged to comply with all customs and foreign exchange regulations. If he is prohibited from continuing the journey due to the offense, all costs will be borne by the passenger.
HEALTH REGULATIONS
A traveler traveling to a country for which vaccination is prescribed by the World Health Organization must be vaccinated and obtain an appropriate document (“yellow booklet”). The passenger has the right to health care at home and abroad to the extent and in the manner determined by the regulations of the Health Care Institute, which is in the area where the passenger is regularly insured. In countries without a health care convention, the traveler bears the cost of treatment himself. In the event of cancellation of the trip, the costs of vaccination are not reimbursed to the passenger.
LUGGAGE
The transport of luggage up to the weight determined by the carrier is free of charge. The Agency does not accept responsibility for loss, theft or damage to luggage. Your claims with the relevant documents must be delivered directly to the carrier or hotelier who is resolving your complaint.
SALE OZ. ARRANGEMENT OF ARRANGEMENTS
TA Majolka is not responsible for services on programs where she does not act as an organizer, but only as an intermediary in concluding a contract for organizing a trip. In such cases, he is responsible only for information or. mediation. The information received from the organizer is handed over to the passenger. The conditions of registration, payment and possible cancellation of the trip are in accordance with the applicable conditions of the organizer. It is considered that TA Majolka sells such programs in a foreign name and for a foreign account. Any complaint is handled by the passenger with the organizer of the program, and TA Majolka can intervene in the rescue or. offer assistance to the passenger or organizer in mediation.
TELEPHONE SALE OF TOURIST ARRANGEMENTS OZ. TRAVEL
In the case of telephone sales of tourist arrangements, the contract is considered concluded by providing a credit card number or. in the case of an agreement on payment by bank transfer or payment at the branch, by providing personal data of the passenger and other participants. In this case, the passenger is obliged to pay for the ordered service based on the reservation number within 3 days of the registration, unless specified or. agreed longer or shorter deadline. In the event that the passenger does not pay within this period, it is considered that the contract has not been concluded. It is considered that the passenger has accepted the provisions of these general terms and conditions and offers at the time when he ordered a travel arrangement by phone or. travel.
SALE OF TOURIST ARRANGEMENTS OZ. TRAVELING THE INTERNET

By signing the contract, the passenger is considered to agree to the use of this information in order to fulfill contractual obligations and rights, as well as for direct marketing, market research, customer segmentation, statistical processing and notification of TA Majolka and its business partners. If the passenger does not want this, he can state this when registering for the trip.
